Why are rent agreements made for 11 months? Do I need to register it?

Simple answer

A lease for over one year (or year to year) must be registered, which costs more stamp duty and fees. An 11-month agreement avoids that in most states. It still needs proper stamp duty, and some states, like Maharashtra, require every rent agreement to be registered.

Real-life examples

Ayesha signs an 11-month agreement on stamp paper of the right value. In her state, it does not need registration. When it ends, she and the landlord sign a fresh agreement.

Rohan in Pune signed an unregistered 11-month leave-and-licence agreement. In Maharashtra every such agreement must be registered, and the landlord is responsible. If it isn't, the landlord can be punished, and Rohan's version of the terms is presumed true unless proved otherwise.

Joseph signed a 3-year lease but never registered it. He cannot rely on it to enforce the 3-year term. His tenancy may be treated as month to month.

What should you do?

  1. 1Write down the rent, deposit, notice period, lock-in, repairs and who pays which bills. Both sides should sign every page.
  2. 2Pay the correct stamp duty for your state using e-stamp paper or franking. An unstamped agreement can't be used as evidence until duty and penalty are paid.
  3. 3Register it at the Sub-Registrar's office if the term is over one year, or if your state requires registration for all terms.
  4. 4Landlords: submit tenant details for police verification where your city's police require it.
  5. 5In states with a Model Tenancy Act-style law, inform the Rent Authority within the time allowed (two months in the model law).

Exceptions & limits

  • An 11-month agreement doesn't let the landlord throw you out on the last day. If you stay on and he accepts rent, the tenancy continues month to month, and notice and due process still apply.
  • Getting an agreement notarised is not the same as registering it. A notary only attests signatures; it does not replace registration where registration is required.

Maharashtra: every leave-and-licence or tenancy agreement must be written and registered; the landlord is responsible and can be punished.

Model law: renting only by written agreement, reported to the Rent Authority within two months. Applies only where a state adopts it.
